General terms and conditions

These general terms and conditions ("Guidelive GTC"), together with the Privacy Policy govern the use of the GuideLive online mediation platform. Acceptance, without reservation, of these terms of use becomes necessary for the provision of the service by GuideLive. Users declare when registering on the platform that they have read, understood and accepted these terms of use, which are available to them at any time. The present GTC of GuideLive applies to all visitors and users of the GuideLive platform and to all content on the offered operating systems.

About us

GuideLive is an intermediate platform offering online tours from various local touristic activity providers, such as professional and amateur tour guides, museum and cultural institution employees, historians, and tour agencies ("tour guides"). Activities include, for example, guided tours, cooking classes, sightseeing tours by bus, boat trips, sightseeing tickets and other services. We act as a commercial agent for tour guides. The descriptions, photos and other content for each activity are the property and responsibility of the respective guide. For more information, please check under the "About us" link on our website.

Definitions

Service: The above described tour service platform.

Content: All material (such as descriptions, photographs, documents and three-dimensional objects related to the tour) available through the service. All such material may be renewed and/or replaced when adding and editing the available tour experiences.

Live & Prerecorded tours: Remote tours offered on Guide Live's platform can be either Live or Prerecorded. . During Live Tours, the Guide might be situated in the Point of Interest (POI) and users can join the tour from their respective locations. Alternatively, Guides can provide their services by running the online meeting from home, while users are located at the POI and use their device’s camera to share their surroundings. Prerecorded Tours are available at all times to anyone purchasing the experience.

User / customer: Any visitor of the service, who browses the content of the service.

Tour guides: Any activity provider responsible for planning and conducting the tour.

Payment: Τhe price paid by each user for the purchase of a tour service through the platform, in accordance with these terms and conditions.

GuideLive Applications: GuideLive's service is available through a browser on your computer, as well as from a smartphone through the iOS and Android apps. For users of mobile applications, the experience purchase takes place through a redirect to the GuideLive Service website.

Use of GuideLive applications

By agreeing to the Terms and Conditions, you are granted permission to download, install and use the GuideLive applications on your device, provided that your installation and use of the GuideLive applications is solely (i) for your personal use and for non-commercial purposes (with the exception of registered guides) and (ii) compliant to all limitations and commitments set forth in these general Terms and Conditions. You may not copy, transfer, lease or grant access to a remote tour experience that you have booked, unless you have purchased seats for all parties you share access to the tour with. Copying, forwarding, transferring, storing and modifying the content is also prohibited (see below).

Sign up / Create an account.

The service is open to all guests, but registration is mandatory to access all of the features of the service, such as making a reservation or adding an experience to your favorite list. To create an account ("GuideLive account"), you must enter your full name and email address in the registration form on the GuideLive platform and you can set a password. Keep this data secure so that no third party has access to your account. After clicking on the "Confirm email" button, you will receive a welcome email from GuideLive as confirmation. Your GuideLive account has now been created.

Registration as a tour guide.:

In order to register as a Guide on the GuideLive platform, a simple user account is required. Once you have created an account with the service, select the “register as a Guide" button located on the Home screen and follow the steps by uploading the necessary documents, such as a public identification document (ID or passport) and a photo for your profile. Registration in the service of GuideLive is valid indefinitely for ordinary users, while registration for tour guides/ experience creators lasts for the period for which the public identification document required when you register as tour Guide is valid. After the expiration of this document, you are obliged to update your information through the “My Account” menu or by contacting GuideLive.

Main Features:

The search feature allows you to discover tour experiences based on various parameters, such as location, dates, language, category and type of tour. The search function on the homepage will show you all the activities that match your criteria, sorting them by availability and ratings.

After selecting the desired experience, GuideLive offers booking services , where users purchase one or more seats for a remote tour. To access the tour, users may follow the link received in their email.

Finally, there is the teleconference function that allows the remote tour to be conducted, while also supporting user accessibility with functions such as subtitles and sign interpretation. In case of live tours, users may join via the Join Tour button on the experience details page.

There is also the menu for registered Tour Guides (agent dashboard) which offers them tools for detailed designing a remote live or prerecorded tour, as well as management tools for tracking their business on GuideLive.

Finally, ysers who have purchased and attended a remote experience on GuideLive can rate their experience from the button "Bookings">"History".

Necessary Equipment:

To use the service, you must have access to the internet and an internet-enabled device, and in addition, in the case of smart mobile applications, sufficient storage space for the device to function properly. Ideally, users have 5G connection. GuideLive bears no responsibility whatsoever for any inability to access its services, which is related to the unsuitability of the device used or the inability to connect to the internet at the required speed.

Bookings:

When you book a guided tour service on the GuideLive platform, you purchase directly from the guide. Therefore, at GuideLive we do not act as tour guides and are parties to any service agreements, but these are concluded by us on behalf of and on behalf of the tour guides. As a commercial agent of tour guides, GuideLive has the right to trade between tour guides and users, e.g. collect payments from users. We also receive a commission from the supplier for the mediation on the service agreement.

Payment methods:

Users can purchase an experience using a credit or debit card, and transactions take place via a secure environment (Viva Wallet). It is recommended to check the order details before completing the transaction. Make sure you are informed of any potential additional charges,e.g. in case of entrance fees to a location.. Upon successful payment to GuideLive, payment obligations to the supplier are fulfilled with due effect. If an experience must be paid in a currency other than your local currency, you might be charged with a currency commission fee.

Changes in pricing:

The Guide/ creator of each experience reserves the right to change the prices of the tours offered at regular intervals. Any such change will not affect your charges for the experiences you have already booked, and will not be made without your notice.

Cancellation of reservation:

You can cancel a reservation you have made for a GuideLive experience, and receive compensation for it up to a few days before the start date. In particular, depending on the arrangements set by each tour guide, you can cancel your reservation and receive full compensation if you take a related cancellation action One (1) to three (3) days before the start date of the experience. If you make a cancellation at a time closer to the starting date than that set by the guide, you are not due compensation.

Further rights of the Tour Provider:

The provider may exclude you from an activity if (i) you do not meet the conditions for participation specified on the GuideLive platform, (ii) endanger yourself or others through your participation, or (iii) disrupt the implementation of the activity in any way. In these cases, the booking price paid for the activity will not be refunded. Updates:

GuideLive may occasionally develop and provide updates to GuideLive applications, which may include upgrades, bug fixes, patches, and/or new features (collectively, including related documentation, "updates"). Updates may also modify or delete certain features and features in their entirety. You agree that GuideLive has no obligation to provide notices of any updates or to continue to provide or activate certain features or features. Based on your mobile device settings when the device is connected to the internet: GuideLive apps will automatically install all available updates, or you may receive notifications to install available updates manually, depending on the settings you have set and the storage space available on your device. You acknowledge and agree that the GuideLive applications or parts thereof may not function properly if you do not make the necessary updates. You further agree that all updates will be considered part of the GuideLive applications and will be subject to all terms and conditions of these GTC. You acknowledge that when you download, install or use the GuideLive Apps, GuideLive may automatically use means (including, for example, cookies) to collect information about your mobile device and your use of GuideLive Apps. All information we collect through or in connection with The GuideLive Apps is subject to our Privacy Policy. You can control certain data processing activities by choosing not to give your consent when requested by The GuideLive App.

Uploading content on the platform:

When designing and posting an experience, you must ensure that you have the necessary rights to use images, files and any material before uploading it. The content you upload for an experience must not violate legal provisions, morals and/or the rights of third parties. In particular, you may not upload and/or make publicly accessible any user content depicting violence, pornography, offensive and racist content, product of pseudo-archaeology, defamation or other illegal content. Furthermore, images or photos in which we can see other people can only be uploaded to The GuideLive platform if those people have given their consent. If you want to use photos taken by someone other than yourself, you will also need that person's consent. You retain ownership of any User Content you create. You grant GuideLive a non-exclusive, downloadable (through one or more levels), worldwide, fully paid and royalty-free license to all means now known or discovered or developed for use, reproduction, adaptation, translation, creation of Derivative Works, modification, performance, public display, public performance, transmission and distribution of User Content., including (I) On The GuideLive platform or through it (ii) on or through GuideLive partners and (iii) on online and offline marketing materials.

Content Removal:

We may remove User Content as required and at our sole discretion. For example, GuideLive may remove User Content if, in our opinion, it violates the obligations described in this document. We are not obliged to keep copies of the User Content or provide such copies.

Republishing Content:

t is strictly forbidden to post User Content of the GuideLive platform that: (i) is untrue or misleading, (ii) advertises products, services or companies overtly or covertly, (iii) is created for a fee by a third party, (iv) is created by or at the direction of the supplier providing the activity, (v) violates the intellectual property, privacy or other rights of a third party.

Advertising:

GuideLive reserves the right to display advertisements and other information next to or with User Content on the GuideLive platform, as well as other media. You are not entitled to any compensation for these advertisements.

Data protection:

All your personal data collected through the GuideLive platform is processed by GuideLive as part of its role as a data controller, in accordance with the relevant data protection legislation and for the purposes described in the Privacy Policy. GuideLive discloses your personal data to suppliers to the extent necessary for the performance of the service agreement between you and supplier or when necessary to comply with a legal obligation and for other purposes permitted by law. The suppliers are independent data controllers and are solely responsible for the processing of your personal data. In the Privacy Policy section you will find detailed information on how to exercise your data protection rights.

During the tour:

If you have made a tour reservation for which your presence is required at a specific location, you must arrive on time at the meeting point indicated by the tour guide. Also take into account the responsibility for any necessary travel documents (passport, visa, etc.) and to comply with sanitary or other requirements. In the event that you or a travelling companion suffer any kind of injury or loss of personal belongings during an activity or in connection with an activity ("accident Event"), GuideLive assumes no responsibility.

Disclaimers:

To the fullest extent permitted by applicable law, we are not liable for any indirect, special, incidental, consequential, exemplary or punitive damages, including damages for loss of data, loss of profits, loss of revenue or cost of supply of substitute goods or services, regardless of how they were incurred and on the basis of any alleged liability, including contract or tort (including product liability, of objective liability and negligence) and regardless of whether we were or should have been aware or informed of the possibility of such damage and despite the non-observance of the basic purpose of any remedy mentioned herein.

Applicable Law:

All the conditions and terms of use of the service, as well as any modification or replacement thereof, are regulated and supplemented by the applicable national and Community Law. These terms of use are the basic terms of the agreement for the provision of the service by the Cine.gr to the users. The courts of Athens are responsible for resolving any dispute.
